CONSTITUTIONAL SAFEGUARDS
The constitution of India guarantees many rights to the child under
fundamental rights and under directive principles.
FUNDAMENTAL RIGHTS
Andhra Pradesh ranks nineth in the country in terms of children’s (6-13 years) school attendance. Only 76.2% girls and 82.4% boys from the total population in that age group attend school of every 100 children who are enrolled 25 do not reach secondary level. There are about 9 lakh child labourers in the state (Report of the state Advisory Board on child Lab our, 2007).
Under fundamental rights, the constitution guarantees the following rights to the child, which are enforceable against the state only through the high courts and the Supreme Court.
- Right to equality - Articles 14-17
- Right to Freedom - Articles 19-22
- Right against exploitation - Articles 23-24
- Right to Freedom of religion - Article 25
- Cultural and educational Rights - Article 29
- Right to Constitutional Remedies - Article 32
DIRECTIVE PRINCIPLES
Under Directive Principles, the constitution guarantees the following provisions and the state has the duty to apply these principles in making laws.
- Ban on unsuitable work and facilities for them -Article 39
- Maternity relief, just conditions of work - Article 42
- Free and compulsory education for children till 14 years - Article 45
- Right to Nutrition and health - Article 47
